1. Booking eligibility
1.1 The person making the booking must be aged 18 or over.
1.2 If CL Paints reasonably believes that a booking has been made by a person under the age of 18, we reserve the right to request suitable evidence of age and may refuse to provide the service where the booking requirements have not been met.
1.3 The minimum age for a participant to receive face painting at a private event is 3 years old.
2. Booking information and attendance
2.1 The client is responsible for providing accurate information when making a booking, including the date, venue, times and a reasonable estimate of the number of people expected to attend.
2.2 The estimated attendance provided by the client is used by CL Paints to assess the requirements and suitability of the booking.
2.3 If the expected attendance changes significantly after the booking has been made, the client should inform CL Paints as soon as reasonably possible. We may recommend additional booking time where appropriate.
2.4 The number of attendees stated on the booking form does not represent a guarantee that every attendee will receive face painting.
2.5 CL Paints is booked to provide its service for the agreed period of time, rather than to complete a guaranteed number of face paints.
2.6 The number of participants who can be painted during the booking will vary according to factors including the designs requested, participant cooperation and reasonable operational circumstances.
3. Booking duration
3.1 CL Paints will provide face-painting services between the agreed start and finish times stated on the confirmed booking.
3.2 We will paint as many participants as reasonably possible during the agreed booking period.
3.3 The presence of participants still waiting to be painted at the agreed finish time does not automatically extend the booking.
3.4 Face painting will stop at the agreed booking finish time, regardless of whether participants remain waiting.
3.5 Clients should therefore consider their expected attendance when deciding how much face-painting time to book.
4. Additional time and extensions
4.1 If additional face-painting time is required, the client may ask CL Paints to extend the booking.
4.2 Additional time is entirely subject to availability. CL Paints is under no obligation to extend a booking beyond its agreed finish time.
4.3 Additional time is available in 15-minute increments and will be charged at the applicable additional-time rate advised to the client.
4.4 At the original agreed finish time, face painting will stop before any extension is discussed, confirmed or commenced.
4.5 Before additional time begins, the client must confirm the amount of additional time requested, agree to the additional charge, and make the required payment.
4.6 Face painting will only resume once the extension has been confirmed by CL Paints and payment has been received.
4.7 Once confirmed, the agreed additional time will be added to the booking and a new finish time will apply.
4.8 Purchasing additional time does not guarantee that every participant remaining in the queue will be painted.
4.9 CL Paints may refuse an extension where another booking, travel requirements, staff availability, venue requirements or other reasonable operational circumstances prevent us from remaining at the event.
5. Arrival and set-up
5.1 CL Paints may arrive at the venue up to one hour before the agreed start time to allow adequate time for set-up.
5.2 Reasonable set-up time before the agreed booking start time is not chargeable to the client.
5.3 The client should ensure that CL Paints has reasonable access to the venue and the agreed working area in sufficient time to set up.
6. Deposits and payment
6.1 A deposit of 50% of the total booking price is required to secure the booking.
6.2 The deposit will be requested using a payment link sent to the email address provided by the client.
6.3 Unless otherwise agreed in writing, any outstanding booking balance is due on the event date.
6.4 Accepted payment methods may include cash, card or bank transfer. Relevant payment information will be provided to the client.
6.5 Additional time purchased during an event is payable before the additional service begins, in accordance with Section 4.
6.6 Where an amount properly due remains unpaid, CL Paints reserves the right to take reasonable steps to recover the outstanding amount. This may include using an appropriate debt-recovery process where necessary.
7. Travel
7.1 Travel within the first 10 miles from CL Paints' trading address is included.
7.2 For bookings located more than 10 miles from our trading address, a travel charge of £1.00 per one-way mile beyond the included 10 miles will apply, calculated using the shortest recommended driving route.
7.3 The maximum travel charge is £50.00.
7.4 Any applicable travel charge will be advised to and agreed with the client before the booking is confirmed or payment is taken.
7.5 CL Paints reserves the right to decline bookings outside our normal operating area.
8. Cancellation by the client
8.1 If the client wishes to cancel a booking, a minimum of 48 hours' notice before the event is required.
8.2 Cancellation should be provided to CL Paints by email.
8.3 Where less than 48 hours' notice is provided, CL Paints reserves the right to retain the deposit, subject to the client's applicable statutory rights.
9. Cancellation by CL Paints
9.1 In the unlikely event that CL Paints has to cancel the booking and cannot provide the contracted service, any deposit paid for that service will be refunded.
9.2 Nothing within these Terms & Conditions affects any statutory rights available to the client.
10. Safety, allergies and health
10.1 Face painting involves the use of cosmetic products and, although CL Paints takes reasonable precautions, reactions or other incidents may still occur.
10.2 Participants, parents or guardians are responsible for informing CL Paints before painting begins of any relevant allergies, skin sensitivities, illnesses or other circumstances which may affect whether face painting is suitable.
10.3 CL Paints reserves the right to refuse to paint a participant where we reasonably consider that proceeding would present a health, hygiene or safety concern.
10.4 Where appropriate following an accident or injury involving our service or equipment, CL Paints may record the incident and seek appropriate medical assistance where required.
11. Participant conduct
11.1 Participants must follow reasonable instructions provided by CL Paints relating to the safe delivery of the service.
11.2 CL Paints operates a zero-tolerance policy towards abusive, threatening or inappropriate behaviour towards our staff, customers or property.
11.3 CL Paints reserves the right to refuse service to an individual or, where reasonably necessary, cease providing services where abusive, threatening or unsafe behaviour occurs.
11.4 Serious incidents may be reported to the venue, event organiser, police or other appropriate authorities where necessary.
12. Equipment and personal property
12.1 Equipment supplied and used by CL Paints remains the property of CL Paints.
12.2 Participants and guests should not interfere with or use CL Paints equipment without permission.
12.3 Where CL Paints equipment is deliberately or negligently damaged by a participant or guest, CL Paints may seek reasonable costs arising from that damage from the person responsible, where legally recoverable.
12.4 Clients and participants remain responsible for looking after their own personal possessions. CL Paints will not be responsible for loss of or damage to personal property except where liability cannot lawfully be excluded.
13. Photography and video
13.1 CL Paints may offer clients and/or participants the opportunity to consent to photographs or video being taken for purposes such as our website, portfolio, social media or marketing.
13.2 Photography and marketing consent is optional and is not a condition of receiving face-painting services.
13.3 Where a child is involved, appropriate consent must be obtained from their parent or legal guardian before identifiable photographs or video are used by CL Paints for promotional purposes.
14. CCTV
14.1 Where CL Paints operates CCTV at an event, it may be used for legitimate purposes including security, crime prevention, incident investigation and safeguarding.
14.2 CCTV footage will normally be retained for up to 28 days, unless it is reasonably necessary to retain particular footage for longer in connection with an incident, legal obligation or other legitimate requirement.
14.3 Further information about the handling of personal information should be provided through CL Paints' applicable privacy information.
15. Weather and circumstances affecting the event
15.1 Where circumstances outside the reasonable control of CL Paints make it unsafe or impractical to continue providing the service, we may need to temporarily suspend or end face painting.
15.2 This may include severe or unsuitable weather conditions affecting an outdoor event or other circumstances which create an unreasonable health or safety risk.
15.3 Where the service has to end early in such circumstances, any adjustment to the amount payable will be considered according to the circumstances and the service already provided.
16. Revenue sharing
16.1 Where CL Paints and the client have expressly agreed a revenue-sharing arrangement for an event, the applicable arrangement will be agreed separately as part of the booking.
16.2 Any amount due to the client under an agreed revenue-sharing arrangement will be calculated and paid using the agreed method following the relevant booking period.
17. Complaints
17.1 If a client wishes to make a complaint, they should contact CL Paints at info@clpaints.com or use the relevant contact/information form provided by CL Paints.
17.2 Complaints will be handled professionally and personal information relating to a complaint will be handled appropriately and in accordance with applicable data-protection requirements.
18. General
18.1 These Terms & Conditions form part of the agreement between CL Paints and the client for the provision of the booked services.
18.2 Nothing in these Terms & Conditions is intended to exclude or restrict any liability or consumer right which cannot legally be excluded or restricted.
18.3 Where any provision of these Terms & Conditions is found to be unenforceable, this will not necessarily affect the remaining provisions.
