Client photograph uploads

When you choose to share photographs, we record your verified account, responsible person's name, signature, consent wording, submission date and the names and identifying descriptions of the people shown. These records remain private. We review uploads before using approved images in our portfolio, website or social media. Embedded image metadata is removed from website copies.

Photo sharing is optional. You can withdraw permission in the client portal under My events → Upload photos or contact us. Withdrawal removes the photographs from this website and stops new use. Contact us about social media, printed copies, deletion requests or copies outside our control. We retain release records while needed to document authorised use and deal with privacy requests.

We gather, use, store and transfer your personal data to provide services to you. This data can include your name, contact details, address details as part of our relationship with you. The collection and use of all the data we collect about you is subject to strict controls and is limited to a specific purpose(s).

We collect data in the form of verbal or written communication and cookies, from our stall, social media and website activity.

We are committed to protecting all your personal data, whether it falls into ‘special categories’ or not, and we only process data if we need to for a specific purpose, as explained below. We collect your personal data mostly through our contact with you, and the data is provided by you, but in some instances, we may receive data about you from other people/organisations. We will explain when this might happen in this policy.

IF YOU FAIL TO PROVIDE PERSONAL DATA

You do not have to provide personal data but where we need to collect personal data by law, or under the terms of a contract we have with you, and if you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you. In this case, we may have to cancel a service you have with us, but we will notify you if this is the case at the time.

HOW AND WHEN WE COLLECT INFORMATION FROM YOU

Any personal information we collect will be managed in accordance with the Data Protection Act 2018 and the UK retained version of the General Data Protection Regulation (GDPR). All electronic communications are made in accordance with the Privacy and Electronic Communications (EC Directive) Regulations 2003.

Most of the personal information we process is provided to us directly by you for one of the following reasons:

Bookings – we use one booking system. Your personal information will be used to communicate with you regarding details of your upcoming booking and any beneficial information to enhance our services provided to you. Your personal details will be required in case we need to contact you by telephone so we are able to identify we are talking to the right people regarding the booking. if an activity waiver needs to be completed.

Waivers - Your personal details will be required if an activity waiver needs to be completed. We need your details so we can establish the identity of the person(s) participating. Having the correct details is important as you are legally agreeing to terms and conditions, outlined in the form, before their engagement with CL Paints. When you sign the waiver you are acknowledging CL Paints cannot be held responsible for any risks that may be associated with our services.

Photography and videography - You can send us your own photos or videos via one of our forms. Due to the nature of the content we require the personal details of the people within the content. This is to establish the identity of the people involved and will help us to comply with GDPR. If the required information is not provided, the images or videos will not be used and will be deleted.

Customer Enquiries and Feedback – We gather personal information when customers inquire about our services or wish to provide feedback. This allows us to respond in a timely manner.

Data management – We may use information provided by our customers to measure the success of our services. When we analyse this data, it will not be shared with a 3rd party unless anonymised.

CCTV/Closed-circuit camera surveillance – We use CCTV within our stalls for the safety of our staff and customers.

Cookies – A cookie is a small text file which is placed onto your computer (or other electronic device such as a mobile telephone or tablet) when you use our social media page(s). We use cookies on our social media page(s). We do this to find out things such as the number of visitors to the various parts of the site. This information is only processed in a way which does not identify you individually. We use cookies to improve your experience as a user of our social media page(s). We do not use this information to develop a personal profile of you. If we do collect personally identifiable information, we will be up front about this. We will make it clear when we collect personal information and will explain what we intend to do with it. HOW WE STORE YOUR INFORMATION

We retain the personal data processed by us in a live environment for as long as is considered necessary for the purpose(s) for which it was collected (including as required by applicable law or regulation).

In addition, personal data may be securely archived with restricted access and other appropriate safeguards where there is a need to continue to retain it.

We have appropriate security measures in place to prevent personal information from being accidentally lost or used or accessed in an unauthorised way. Those people processing your information will do so only in an authorised manner and are subject to a duty of confidentiality. These purposes may include processing and sorting data, monitoring how customers use the social media page(s), website(s) and issuing our e-mails for us. Applications for the Right to Erasure must be completed and the identity confirmed. We will retain copies of the request for administration purposes. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. In some cases, we may demonstrate that we have compelling legitimate grounds to process your information which override your rights and freedoms.

Request restriction of processing of your personal data. This enables you to ask us to suspend the processing of your personal data in the following scenarios:

You are not required to pay any charge for exercising your rights unless your request is clearly unfounded, repetitive, or excessive in which case we may charge a reasonable fee. Alternatively, we could refuse to comply with your request in these circumstances.

We try to respond to all legitimate requests within one month. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

We may need to request specific information from you to help us confirm your identity and ensure your right to exercise any of your rights. This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

DATA RETENTION

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.
